What are the developer primary responsibilities in the building of your home?
The term developer is used to refer to persons or companies who build and sell residential properties. Under contract law, the developer must complete your home in accordance with the terms and conditions set out in your contract. The developer’s primary responsibility is to complete the development in accordance with the terms and conditions of the building regulations and planning permission.
The Department of the Environment, Heritage and Local Government also has responsibility for setting the Building Regulations, the primary purpose of which is to provide for the health, safety and welfare of people in and around buildings.
Developers are statutorily obliged to comply with the Building Regulations in force at the time of construction. A qualified professional certifies compliance with the Building Regulations when the development is complete. The Building Control Act (2007) gives powers of enforcement and inspection to the Local Building Control Authorities. The Building Control Authority can inspect buildings and enforce the standards required by the Building Regulations wherever required.
